"I can report someone for me to aim high on marijuana? Hypothetical situation?

It's a scenario I just to have a discussion with someone about. I'm the kind of person who is not interested in doing any drugs and never experiment with them. Apparently, the area where live is very quiet about marijuana and even if you get caught with it, not get in legal trouble. Most people I know have tried marijuana or some point in their lives or are occasional users. Now California is put on the ballot to try to legalize. So yesterday someone told me that at some point I will go to a party and someone gives me a biscuit that has marijuana in it and I will not even know it. He said that he would go to an emergency room and immediately a complaint. Everyone tells me I will not have a case and I can not get anyone in trouble for it, especially if it becomes law in November. REALLY?? IF ANYONE CAN NOT ME purpose charges DRUGS??

First, despite popular belief, no individual can "press charges" against anyone. Period. All the victim can is to report the incident to the police, and if no charges are filed against the assailant is a decision that only the district attorney can do. So the absolute response technique to your question is "no" However, assuming that the prosecutor does not pursue criminal action (either because there is no criminal law applies or because they have no evidence or anything else) could sue in civil court. Giving someone drugs or other mind-altering substances (the substance is legal or not) without consent is, without doubt, a battery. If you end up going to hospital, but only as a precautionary measure, then that would be responsible for medical expenses incurred. Potentially, could also damages for pain and suffering or even (though less likely) the emotional distress.
